There is a difference between being "hot" and being unreasonably hot.

The source of the coffee is the problem. Other vendors had the good sense to
take precaution against burning and scalding their customers by making sure the
coffee was served at a temperature that would not scald them.

Its is also the vendor's responsibility to assure that the product is delivered
in a safe manner.

The temperature which this coffee was poured at was 45 degrees above the
temperature McDonalds acknowledged was capable of causing burns and scalds.

That is not a safe practice IMHO.
