TURMEL: Creaky crate cancels Cochrane Cultivation Clash

JCT: Bad luck. Robert Neron's cultivator friend Pierre

Drouin <dpeted@hotmail.com> <705-362-7502> didn't get from
Hearst to court in Cochrane to present his Cultivation Quash
motion because their car broke down and it's 3 hours away.
Sorry if I sent anyone to the Hearst courthouse. It's really
in Cochrane.
 
Pierre's lawyer reports that there was some discussion with
the Crown and the judge about what Pierre intended to do.
The judge said it was a major challenge that would take a
couple of years. I guess he never heard of Turmel getting
through the Aitken "All Sections" appeal in 10 weeks. I
could have been filed in the Supreme Court by 11 weeks
though I waited, the pauper's prerogative.

The good news is that Pierre isn't going to wait but is
going to file the Krieger application to quash his charges as
unknown to law as soon as possible.

The better news is that he's got another friend who was
busted a week later who is also going to file same motion to
quash his cultivation charges with him. A Dynamic Duo.

I told him the best news would be for more busted growers to
join them in challenging their cultivation charges together.
I'll never forget my Heaven Eleven Cast of Cripples laid out
before Justice Blais in the Federal Court wing of the
Supreme Court of Canada building. On Aug. 4, 2001, 3 days
after Terry Parker Day. Quite a show from the "circus
lawyer."

It was the first time asking a judge to declare the law had
died on Terry Parker Day. He did when it had. 7 months
later, Justice Pitt ruled the government had not complied.
SCO Pitt J. gets first glory, FCC Blais J. gets none.

I suggested they found the Association of Busted Marijuana
Cultivators and start searching for other victims in the
small town papers. I'd just like to see them all filed
before I have to make my SCC reply on Nov 16. All fighting
back together. I'd sure like a Titanic Trio or Fabulous Four
or Fearsome Five or Super Seven or Heaven Eleven or even a
Dirty Dozen. Eleven's the number to beat. Why not try? Two
more weeks to build the assault team. Aren't there more than
11 growers who've been made the news in Cochrane area?

Regardless, the more people in on the challenge, the more
likely the judge will at least stay the charges pending SCC
#30570 and #30571 if he won't let them off. And that makes
it more likely that the SCC will let it in; that the Crown
will beg the SCC to let it in.

I still need to see if I can have some charges stayed and
made dependent on my cases before my Nov 16 Reply. Won't it
stink if I don't actually have any cases hinging and can
only announce that I'm still looking for some. If I can get
a few tied in so I can mention it, the probable growth in
numbers would be evident.

Anyway, the few people charged with mere possession have
little to lose compared to people charged with cultivation.
Maybe the Association of Busted Marijuana Cultivators will
be the group to provide the most ready army of guerrillas to
take the legal battle to the Crown in the courts. For free.

As long as they get filed so I can cite them in my Nov 16
Reply to the Supreme Court, they'll all be of use to me. And
of course, finding people with dates in court to just read
in their motions is still best.

Seems Terry Parker did just that, again. I've been given
credit with snagging people right in front of the court-
house but it was Terry. I was contacted by the people I've
helped so far. Terry did the courthouse bit. Twice.

Seems he scored a pretty big possibility and he's mentioned

Dear Marc, In today's SUN there is mention of the
Temperance Society Restaurant arrested form marijuana and
some cash. Eight people were arrested.
I went down today, and gave them five copies of Turmel's
application to dismiss, and reminded them that only
Parliament can re-enact prohibition, not the courts. I've

JCT: Terry's going to do the Sandy Kramer bit again times
eight. The resistance is growing. And I've now got to change
all the forms to reflect the Supreme Court challenges to the
Hitzig resurrection and Turmel "All sections" rulings.
Those forms will be updated and I'll add specific Superior
Court forms for the cultivation charge for Pierre to use by
tomorrow night.

I'll also be posting an updated version of the timeline and
announce the additions.

And I'll be posting an updated version of the mptopics.txt

everyone on Nov 1.
