JCT: Now that both motions got past HMTC, it's safe to tout
the first mention of the Krieger scandal to Quebec.

Supplementing the calls to my friendlies, it dawned on me
that the English guys never come. The Citizen, Sun and Le
Droit have a Turmel boycott, CJOH-TV (CTV), even CBOT-TV.
The only guys who ever gave me honest press recently were
the Quebec media. Anyway, it's been a few years since I've
been away and it's nice speaking to some of the better ones
again after having been in the Ontario boonies for so long.

Nevertheless, I'm going to include the fax to the English
boy, too bad I couldn't put it in French without reprimand
from my school-teacher English-French translator mother. No
English.

Still, when the judges see the English motions, they have to
guess who's involved.

So here's the Fax being sent out to the Ottawa-Gatineau
media. I'm reproducing it so they can find this article with
live links to the smoking evidence. "smoking gun in
Frankel's hands" evidence, not "smoking joint in my hand"
evidence any more.

First Krieger Get-out-of-jail Gatineau case Thursday

On July 29 2004, 31-year-old Dominic Gravel was charged with
the standard "cops and gardeners" marijuana charges of
S.7(1) cultivation and S.5(2) possession for the purpose of
trafficking.

Despite no history of "cops and robbers" style violence, he
was not released on bail and has done 6 months dead time
without even a pre-trial.

TAKE NOTICE that on Thursday Jan 27 2005 9:15am, the
Applicant will make a motion before a judge of the Superior
Court of Quebec in Room #1 of the courthouse at 17 Laurier
in Gatineau for an Order varying the bail conditions to
permit release upon Applicant's own recognizance to avoid
any further compounding of the abuse of the court process of
spending dead time on invalid charges since "Parliament has
not re-enacted the necessary S.4 possession and S.7
cultivation prohibitions sustaining any imputed improper
purpose since they were struck down in Parker and Krieger."

TAKE NOTICE that on February 24 2005 the Defendant will make
a motion before a judge of the Quebec Court at the
courthouse at 17 Laurier in Gatineau at 9:30am for an Order
1) an Order pursuant to S.601(1) of the Criminal Code
quashing all charges relating to marijuana under the CDSA as
unknown to law on the grounds Parliament has not re-enacted
the S.7 cultivation and S.4 possession prohibitions which
underpin all other marijuana prohibitions in the CDSA since
they were struck down by the Ontario and Albert Courts of
Appeal.
2) an Order staying any charges for marijuana as abuse of
the process on the grounds that statute is of no force and
effect.
3) an Order, in the absence of proof that all inmates
convicted since the marijuana prohibitions were repealed
have been released, citing the Ministry of Justice for
contempt of the Ontario and Alberta Courts of Appeal and
Supreme Court of Canada in R. v. Parker and R. v. Krieger on
the grounds Crown Attorney S. David Frankel acknowledged
that the S.7 Cultivation and S.4 Possession prohibitions had
been struck down by the highest court in Alberta but did not
dutifully inform Canada's Law Enforcement to cease and
desist arrests under the repealed statutes.
4) or in the alternative, an Order staying the charges
pending the final determination of the repeal of the
prohibitions by the Supreme Court of Canada in Turmel v.
HMTQ #30570 (Hitzig) and R. v. Turmel #30571 (3.3Kg
Parliament Hill bust under S.5(2)).

Dec 23 2003 Supreme Court ratifies Alberta repeal of S.7
cultivation prohibition in Canada.

1) SCC DISMISSES CROWN'S KRIEGER CULTIVATION APPEAL
The Supreme Court of Canada denied the Crown's application
for leave to appeal the Alberta Court of Appeal decision in
R. v. Krieger where "[57 as matters now stand s.7(1) has
been declared of no force and effect by the highest court in
Alberta."

On Feb 01 2005, Judge Serre will be ruling on an identical
motion to quash three S.7 cultivation charges as unknown to
law in Elliot Lake Ontario. There are 12 Krieger challenges
going on in Ontario, B.C., soon Manitoba, and now Quebec.
The Krieger scandal of a quarter million bogus busts while
the Crown quietly argued the law was invalid is the biggest
judicial scandal in Canadian history.

Also on the same day as Dominic Gravel's motion for release
pending quash of S.7 and S.5(2) charges with Krieger is to
be heard the motion to quash of S.5(2) with Krieger by
Michael Ethier in Sturgeon Falls Ontario. All based on the
Krieger Supreme Court of Canada Ace:

And it's all coming out now, Gatineau, Sturgeon Falls,
Elliot Lake, Comox Valley BC, Manitoba, people getting angry
at finding out that the Ministry of justice lost their case
and knew the law was unconstitutional and declared of no
force and effect and did not tell nor call off the cops.
Why? Because nobody knew because the two reporters gave them
the chance to hide it.

Check out the documentation. Heads are about to roll at the
Ministry of Justice, maybe at a few newspapers too.
