If I recall, the tide was medium, but I was far enough out (given the
depth, the presence of a dock, the bottom) that I was below the low
water mark, not in the inter-tidal bit.
(If I'd known it was significant, I would have known whether or not I
had a legal right to be there.)
I think this person was mainly concerned with the dock/raft, which
would be covered by whatever rules cover permanent moorings in the open
water.
