In California (I think I remember Joerg saying he lives in California) the
employer can have you pee in a cup initially as a condition of employment.
In any event I've had to do that twice here in California. But random drug
tests are not allowed. If you behave as though you are on drugs, the
employer can ask you to get screened more or less immediately, but there
are some requirements the employer has to satisfy before they can do that.

At least that is my understanding. I don't really care that much because I
don't use any drugs (well, I drink coffee regularly) and nobody has ever
accused me or suspected me of using drugs and nobody has ever asked me to
get screened, except when I was a new hire, as mentioned above.

Still, I know of a few people who have NOT applied for jobs precisely
because they weren't willing to quit smoking pot for a few weeks in order
to pass the pre-employment drug screening. IMO, these people's priorities
are all screwed-up, even if the drug screening business is stupid. (Which
it is, because alcohol is the most abused drug in the US, and it's not
even illegal.)
