A retired IRS agent was asked, on one of the talk shows, why they can't cross-reference employer's payroll numbers with employees 1040s to find illegals. A: "Not allowed to."And that is exactly the problem. Sure, they should not do that as a fishing operation w/o warrant. But what is the problem with requiring every H1B holder to sign that he or she allows cross-checking 1040 data against prevailing wage for the maximum duration of that visa, which AFAIK is six years if the employer files for a one-time extension?
The context of this discussion was how to detect under-the-table wages paid to illegals. The issues are similar though. I don't see it as a "fishing expedition" any more than checking my interest claims against the 1098s issued by the bank (or W2s and my claims).
That wouldn't be fishing since it's within the same agency. Everyone who is honest has nothing to worry. Legality issues can come up when one agency peeks into the records of another.
As to under-the-table wages there is the usual path: Banks or convenience stores are wiring big chunks of it across the border. Now if that ain't an easy monitoring point then I don't know what is. If John Doe has wired a dozen chunks of money over the course of a year and there is neither a workmans comp insurance for John Doe nor is there a tax return ever then that should be pretty clear.
