Since it's a civil matter that figures. It's down to the store owner.

"Charges of theft" is not a civil matter.

Without a theft being reported, where's the crime ?

In the US, the state can act on an unreported crime. Nobody has to
report you to get a speeding ticket. The cop just has to be able to
catch you.
