it's *not* necessary to convict.

You are assuming without proof that that was the owner of the flag.
It is likely that that was just two employees of the owner.


In any event, if the wronged party doesn't complain, the police are
VERY unlikely to do anything, and the chance of prosecution is
theoretical only.

I once witnessed and reported (in real-time) a car break-in. When the
owner--located a few days later-- proved not interested in the hassle
of pressing charges, neither were the police.

Still it was a crime.
