How can you know that for a fact?
Even if he violated company policy in taking those CDs he might still be
protected by various "whistleblower" laws.
If he wanted to play whistleblower he could have saved the data in an
encrypted file on a network drive that he knew would be backed up.
Then he would not have had to steal the CD or the information.
A likely result of his theft is that the CD evidence would be
suppressed by a judge at the request of his golfing buddy lawyer.
