Tom,
1 After we have exchanged emails, you made me believe, you have a
product for sale, not something in the design stages. You asked me to
wire the money for you, and in exchange you will send me a curve tracer
IN PRODUCTION. You never told me it is not ready, you never told me I
need to wait for you to finish-it.
You believed what I believed. But, AFTER you had ordered, as I have
said, I THEN found something that I decided needed to be changed.
(Note: This was for *YOUR* benefit. Perhaps I am too conscientious, or
too much of a perfectionist: Guilty as charged. "Sorry!")
2 You were fast to reply to my emails, before I sent the money to you.
No faster than I usually am.
3 I wasn't able to reach you after you received my money... not on
the phone, and for some reason you didn't check your emails
anymore...
AS I have told you more than once, I am *usually* NOT reachable by
phone. So, no surprise, there! (So why do you keep bringing that up?)
Regarding the delay in checking my email: I DID make at least ONE
"mistake", in all of this: I thought that I could finish the changes
in one or two days, and wanted to get it out to you as quickly as
possible (again: for *YOUR* benefit). When I ran into more problems
than I had anticipated, I hunkered down and continued working on the
problem, to the exclusion of all else, for about 18 hours a day (for
*YOUR* benefit), always thinking that SURELY it would be done THAT day.
A week or so might have passed (Heck, I'll even say that maybe it was
a little longer than that.), during which time I did nothing else (for
*YOUR* benefit). But, by then, when I finally did take the time to
try to check my email, I found that it was inaccessible! I later
learned that YOU had sent over 2 *GIGABYTES*(!) into my inbox, at my
ISP, making it impossible for me to even READ any of my email, much
less respond to you.
4 I had to flood your email box, and I had to post messages on the net,
to get your attention. Without these you didn't respond to my emails
for weeks.
"Had to" flood my email box????!!!!! That is a CRIMINAL act!!!!!
If you were in the USA, instead of in Hungary, you would now be under
arrest and facing criminal charges in a court of law, and could be
forced to pay me thousands of dollars for the damages you have
inflicted!
Didn't respond "for weeks"? Yes, YOUR denial-of-service attack kept my
email inoperable for about that long!! My ISP finally had to delete it
*ALL*, since it was in one big 2 GB ASCII text file (POP-type,
apparently), on their server, and even they couldn't find a reasonable
way to go in and delete only the hundreds of HUGE emails that were from
you.
My first real information/communication, from you, then, was when I
"just happened" to see one of your "fraud"-warning posts, in
sci.electronics.equipment!
Are you even AWARE of the fact that what you have posted constitutes
another criminal act???! How's life there in Hungary, anyway? Are the
Communist/criminal thugs still running the place with threats,
extortion, blackmail, and violence? Or was it just that way for so
long that it still seems normal to y'all?
FYI: In the CIVILIZED parts of the world, we try not to let things
operate that way.
Telling lies that ruin someone's business venture is a very serious
crime, which exposes you to huge potential costs. If you are
successful, you could be held liable for all of the potential future
earnings of the business that you wrongfully damaged. I hope that you
are very wealthy. (It would, among other things, make you a
much-more-viable legal target.)
5 You gave me 4 different shipping dates for the curve tracer you claim
to have.
I don't think so. But... hell... possibly. Your harassment, alone,
given the situation I was in, might have been reason-enough for me to
want to be too optimistic about exactly when I might be able to get
everything "nailed into place", to satisfy you. But seriously, if I
said it, then that is what I believed at the time. Sometimes, "***
happens". And sometimes, "more *** happens". I guess there's now
yet-another version of Murphy's Law: When "The Customer From Hell"
comes your way, he cannot be satisfied, no matter how hard you try.
What the .... ?? If I gave you "4 different shipping dates", then I
must have emailed you more times than you are trying to lead people to
believe. Gotcha.
NOT that it matters, at all, in this context, but: Even for the minor
circuit-change that resulted, there was a lot of interacting and
co-dependent work that got generated, including re-layout and
re-manufacturing of a PCB, parts-list changes, inventory/ordering new
parts, assembly-diagrams' artwork changes in many places, re-writing
step-by-step assembly-instructions, etc etc etc. And it's sometimes
very difficult to tell how long it will all take, ahead of time,
depending on the extent of the change(s) that were made. Along the
way, I also had to try to find time to worry about my Dad when he had
emergency surgeries, and various other unexpected personal stuff that
came up, not to mention lots of time spent desperately trying to find
ways to salvage the weeks of email that you destroyed, not to mention
trying to catch up on other email and orders from OTHER customers.
The Curve Tracer that I "claim to have?": Oh yes. I do have it. I'm
actually too embarrassed to say how much time and energy and money I
have invested into developing the latest version of it. It's
gorgeous; and fabulous. I have hundreds of satisfied customers who
purchased older versions of it. And the new version is pretty damn
exquisite.
6 I didn't get answer to my emails for 3 weeks again.
Three weeks from WHEN?? From right after you criminally trashed my
inbox? And then, when I WAS finally able to contact you (via your
Google Groups message's "Show Options" menu, IIRC), you said, "No
problem. I understand. I can wait..."!! (You even removed your nasty
messages from the Google archive, per my request.) I couldn't even
USE my email for something like three weeks, after that. And by then,
I was so far behind, in almost every way, that it took even longer to
get where I COULD have been, long before that, if it hadn't been for
the results of your un-civilized (and worse) behavior.
Please tell me if I'm wrong... I have all of our emails, I will be
more than happy to share it with anybody.
Gyula
You are wrong!! (DUH!!!) [Arrgh....!!]
For your future reference: It is certainly "considered to be bad form",
OR much worse, to publicly "share" private emails, without the
permission of the author.
BUT, in this case, you HAVE my permission!!! And I have some real
"DOOZIES", from you, that I would LOVE to show everyone. Is that OK
with you???!! *** Your manner of threatening people with whom you do
business might be of great interest to others. ***
As I have told you, very politely, several times now, by email:
***************
Due to your behavior, I do not WANT you, as my customer.
I have offered you refunds, several times, and politely asked what your
preferred payment-method is.
***** You have repeatedly refused to accept a refund! *****
(And, of course, YOU could have requested a refund at any time, but did
not do so. [I ALWAYS cheerfully refund any customer's money upon
request, "no questions asked". Heck, for the PDF technical manuals on
CD that I sell as a sideline, I refund money even if NOT requested, if
I just happen to SENSE any dissatisfaction, and also tell them to keep
the manual. BY THE WAY: If anyone wants immediate independent
corroboration of my claims of honorable business practices, take a good
look at the hundreds of 100%-positive feedback comments for eBay.com
user tom_gootee!])
***************
And, in your emails to me, you have explicitly threatened to continue
to post nasty messages about me, "10 per day", you said (and also
threatened much worse things), if I did not send you one of my Curve
Tracers, "received within 48 hours". And you said that only THEN would
you remove your messages from Google's archive.
(FYI: Maybe you also didn't realize that your libelous messages had
probably already been distributed worldwide and re-archived on many
other systems, so that removing them from Google Groups could not
possibly undo the damage that you may have done. Not only is that "a
bad thing", especially for me. It also makes your entire threat scheme
less-meaningful, since, EVEN if I complied, you couldn't possibly
fulfill your part of the bargain. Moron!)
Are you NUTS???!!!
Please, listen very closely, now, Padi Gyula:
I WILL *NOT*, under *ANY* circumstances, now or in the future, EVER,
send you ANY product.
BY THE WAY: Your refund is on its way to you. DUE TO THE FACT THAT YOU
HAVE REPEATEDLY REJECTED MY REFUND OFFERS, for a long time now, I have
simply taken the liberty of sending your money back to you, via the
same way that you originally sent it to me: through Western Union. I
will email, to you, the details that you need, to pick up the money at
your local WU office. (But, oh, gee... I DO hope that MY email reaches
YOU before my ISP's email reaches your ISP!) [The sender's fee was
$56. I'll just add that to the damages that you owe me.]
BY THE WAY: In one of your very few somewhat-friendly emails, you said
that you were "in the same business" as I am in. This may be a
stretch, but, if I try really hard, I can be almost as paranoid as you
apparently are, in which case I might wonder if maybe you are "in
competition" with me, or feel that you are, or want to be. Could THAT
be why you are falsely accusing me of fraud, and trying to ruin my
business? Could THAT be why you have been threatening me, in order to
try to get me to send you my latest-and-greatest design, rather than
simply accepting my repeated refund offers? Personally, I think
"probably not", although, I have been known to be somewhat naive, at
times. But, if I did think about it that way, there would appear to be
at least the possibility of "the appearance of impropriety" on your
part, here, also.
I have already spent FAR too much time and effort on you. You are
wasting everyone's time and energy. But I will say, about myself, that
I have always tried to be honorable-to-a-fault, honest, hard-working,
and the best at whatever I do. And, ever since I've been in business
for myself, I have always tried to make sure that my customers were
happier than they thought they would be, and have, many, MANY times,
gone WAY above and beyond the call of duty.
