I don't know your definition of "evolution" but to me, your claims
(especially #1) might be interpreted as patenting Microsoft Media
Player's visualizations - the crazy patterns that play when you play
music.
The text formulation present in patent claims, often looks rather
complex. In order to increase the readability of said claim #1, you could
try reading it parts like....
a) A method that is using an evolution based approach for improving or
creating audio and / or visual designs k n o w n for it...
b) utilizing a computer software that generates a set of audio and or
visual designs ...
c) for the user of the system ...
d) so that the user can select best design or designs ...
e) according to his/her liking the properties present or absent among the
presented set of designs
And, I think you should especially note the word "select", present in
clause d. As, for example, the "Microsoft Media Player's visualizations"
in it's "crazy patterns" don't need to be "selected" (for further
evolution) in any way - patterns just maintain their built-in craziness.
Looking at your links didn't seem to help me much. All I saw on
the first one was some empty rectangles, and on the second link just
some horizontal and vertical gradient bars.
I think you should have looked more carefully. As you saw the rectangles,
you must have also seen the texts right on top of the page (because the
same php-script writes the instructions _before_ it writes any of the
"rectangles". Ok here is the text...
"Instructions:
* Click on the design that has most of the (color / pattern / form) -
thing that you want
* Top left corner screen is always hosting the, so far, best design.
Choose that one, if there is no better choice
* <link>more instructions...</link>"
And by clicking the "more instructions"-link you would have seen the
following ...
"Instructions:
Click on the design that has most of the (color / pattern / form) - thing
that you want
* Top left corner screen is always hosting the, so far, best design.
Choose that one, if there is no better choice
* Up/down zoomed versions, of your (so far) best design, may be present
in three design screens below the "RESET EVOLUTION"-button
* Use 'Magnify'-links to save your images locally; before copying those
to your personal hosted website
* By pressing the 'Store' - links, you can save your designs for later
competative review. And when you want to access those your saved designs,
just press "SAVED DESIGNS" - button
* When you've fully explored one (color / pattern / form) - thing, press
"RESET EVOLUTION" button to restart from gray designs. Your saved designs
will survive resets
* Good luck and enjoy :)"
As you had apparently missed the word "select" in claim #1, and also
missed the text "Click on the design that has most of the (color /
pattern / form) - thing that you want" ... Then I understand that it must
have been very confusing to just see some rectangles and not knowing what
do do with those.
However anouther thing that you also appear to have missed is that there
are NO empty rectangles show on the screens. Meaning that on the page
http://www.colordev.com/TILEBG/show_screens.php you should have first
seen couple of light-grayish background images (with Kashmir-patterns)
and if you took a look further down the page you would likely have see
the same Kashmir-patterns, but created using images that have different
color tones, brightness, and (bigger/smaller X and or Y) dimensions. And
you would likely also see images that have the same light color but
instead of Kashmir-pattern some another observable pattern.
And regarding the bar images that you saw in http://www.colordev.com/HBAR/
show_screens.php and http://www.colordev.com/VBAR/show_screens.php well
those pages also had instructions on top of the pages. And perhaps you
also missed that the horizontal vertical bar images on present in
respective pages also looked slightly different in each of the
"rectangles". e.g. some of the bar images appeared e.g. clearly thinner
or thicker or having different colors or different surface '3d forms'.
And yes, you as hundreds of visitors before, could also have selected any
of those bars for further rounds of evolution.
Hard to believe that he could patent a wheel but who knows - some absurd
stuff has been patented. Do you have the patent number on that?
Sorry - I only know what was written in news. And I assume his patent
become voided after he published the fact that he had just managed to
patent "a wheel".
