But that's why we have courts; to judge the facts about whether malfeasance and/or negligence exists. It's not infallible, and certainly quite a few meritless cases make it through the system. Same is true of our criminal courts; perhaps we should stop prosecuting criminals til we're batting 1000 there, too?
