apicoectomy

Hi,
I had root canal done by a dentist about 2 months ago (the second time;
the first time was 3 months ago), but I continue to have sensitivity on
that tooth. Now, the gum around that tooth is swollen with infection.
My dentist referred me to see a endodontist who is recommending
apicoectomy. According to my dentist, something broke at the tip of the
root canal and got stuck in the curve line. According to the
endodontist, this piece is why i am getting infection. Now, he made the
diagnosis just based on what my dentist told him.
I have two questions:
1. Do I really need an apicoectomy? I had root canal done twice for
this tooth already, and I worry that apicoectomy is not going to solve
the problem
2. Can I ask my dentist for a refund or credit to go toward the
apicoectomy produce? Is this customary? The cost of apicoectomy is
around $1300.
