Agency Fails Its Mission

Bad enough that - well into hurricane season - an insurer would
threaten owners of shoreline properties with canceled coverage unless
they install expensive shutters on their buildings within 45 days. That
the ultimatum also carried the blessings of the state's insurance
commissioner, Susan Cogswell, goes beyond the pale.

Last month, Andover Insurance Co. informed policyholders that unless
they installed the shutters on the windows and doors of their shoreline
properties by mid-September, their policies could be canceled as early
as November. The requirement applied to Andover policyholders owning
properties within three-quarters of a mile of the coast or the mouth of
a major river.

Insurance companies have an obligation to protect their financial
well-being (an insolvent company, after all, is going to have a hard
time making good on claims).

As the regulator of the state's insurers, the Insurance Department has
a duty to make sure companies' financial practices are sound. But the
agency's mission statement says it also has a duty "to protect the
consumer by administering and enforcing the insurance laws in the most
responsive and cost-effective manner."

Buying and installing these shutters could cost as much as $100,000 for
a single home - a staggering burden for most property owners. Letting
Andover issue policyholders an ultimatum in the thick of the 2006
hurricane season is not being responsive to consumers. Nor is it being
cost-effective.

Meanwhile, Connecticut's ever-vigilant attorney general, Richard
Blumenthal, has issued subpoenas to nine insurance companies -
including Andover - said to be considering similar measures. He is
looking for antitrust violations.

And Gov. M. Jodi Rell has directed Ms. Cogswell to meet with Andover
officials to overturn or delay the decision. The governor is on the
right track.
