Okay, then stand up and say that (assuming it is true) that it is wrong - not
that "it happens" and so forth.

This attitude ends up costing all of us. I have a family member sued for the
price of an "Italian tile" floor. He's a trained tile cleaner and documented
the damage hidden under a piece of furniture to an employee of a client
(lawyers). Guess what? His insurance settled - giving the "victim" a huge
amount of cash. The floor was not Italian tile and the damage was pre-existing
-but rather than go to court they paid out (like the poor victim attorneys
could not see that would happen). Instead of standing up and fighting to stop
this trend, insurance companies are settling rather than pay the legal fees to
proceed to jury trial. Cheaper over a case or two? Probably so. But in the long
run it encourages this kind of "I'll make a buck" behavior. It's not, of
course, an issue, because it didn't happen to you.
