I was shocked after reading here about DOL and then the response I got when
I questioned the DOL about my involvement with another company as an
employee...er...independent contractor. She assigned us the work. She
said she would only pay x per line. She paid by the hour for some things
and we had to turn in an hourly ***. She assigned me stats that had a
one-hour TAT and I had to sit home all day during business hours. I had to
ask for a raise, which I never got, etc. She would have all of the patient
sheets for the account (5 or 7 docs) faxed to my home and then in turn I
would have to fax them to the various subs. I was "in charge" of the
account and the office had to contact me, not the MTSO if they had any
questions. The subs had to contact me, not the MTSO, etc. I documented
and explained this very thoroughly for the DOL representative and he said
that "I" didn't behave as an IC and that nothing she did was in violation
of the SC labor laws because I did "allowed it". He said if I had
exercised my voice as an IC instead of just taking it, then she would have
been in violation. Live and learn, I guess.

I have upped my sub's pay without them asking before because I felt they
deserved it, but the DOL says that is not making them an employee. Heck,
who would've thought someone would complain about being paid more money??
