I think they could, Dani. If they called the MT in question and she referred to her MTSO as her boss rather than her client, it would show an employee mindset.

But isn't it these words right here that make a difference too? Are you really thinking of yourself as a contractor using ICs if you use the word "hire?" Someone might say it's just semantics, but when it comes down to it, does not the DoL use the most minute items to determine treatment as an IC or employee?
