Yes it is, but it is also a risk to anyone "ICing" as far as taxes go. Might not get fined but if you were taking IC expenses, etc., it could mean they end up owing the IRS.
When MTSOs have to tell an "IC" how to run a business, i.e., explain how they have to withhold taxes, etc., I don't think they are really an IC. This is not just in this situation, either, of course.
