The death penalty is applied almost on a random basis.

But isn't that due to the fact that juries are involved? You get 12 people deciding on life and death issues, and you wind up with almost as many opinions, due to the nature of our upbringing, background, and human makeup, in general. Twelve people generally aren't going to think alike. You have 12 people from all different walks of life, sitting on a jury, and you've got a whole lot of diversity in backgrounds, much less their ways of thinking. Sometimes they come up with verdicts that just leave you shaking your head. But that's the way our system works.
