Yes, of course, but there are consequences to disobedience and it still should not make me as the pool owner liable, most particularly if I have taken every possible precaution.

That's the problem. It seems insurance companies will settle when they should not (IMHO), as it just sets precidents for the next guy. If you have a fence and gate that are locked and a kid climbs over and drowns, it should not be your fault. That's bull no matter what. If the kid is old enough to know better, so much the worse, but it still is the parent of those kids who let them out of their sight - even though it can happen easily. Someone on my horse group told a story of a neighbor who came into someone's property (past no tresspassing signs I believe) and got on their horse. I think they were drunk too. Got thrown and injured, sued and won. That's just ridiculous. DH was telling me that a motorcycle in a parking lot is considered an attractive nuisance for kids to climb on. HELLO? Where are the parents and why have these kids not been taught you don't touch other people's property without permission/

Mom had a gate, but the kids busted it. The fence is in bad shape too. Of course, they can't seem to find the money to fix the gate and put a lock on it, but they can find the money for the pool chemicals. (Unfortunately, they're a bunch of idiots.)

I would definitely vote for getting the fence repaired. However, it won't prevent people from jumping it or busting it and still swimming. You would be amazed that neighbors will actually come into your yard to swim in your pool while you are gone from home. It is terrifying and the main reason we have not gotten a pool in our yard yet. Whether insurance will cover it or not, there is always the nightmare of being sued in a civil case, even when you have no trespassing signs, a locked gate, etc.
