Can't help you with the legality, but I think as long as they made that known to you up front (which you didn't say), you have the option of taking the job or not. If you found out after you were hired, I'd talk to someone about that fact and say it wasn't mentioned when you were hired.
When I was working out of doors, the only jobs where I couldn't have an outside job were the ones where I was on salary and would have to work late sometimes, guaranteeing that I wouldn't be able to be on time for a second job.
Frankly, if a job says I can't moonlight, they better pay enough so I don't have to. If it were me and they couldn't accommodate me in some way, I'd leave. I've stayed on at crappy jobs too many times in my life because I was afraid I couldn't get another one to pussyfoot around anymore.
I never regretted the jobs I left. I only regretted the ones I should've left but didn't.
