IMO writing bad checks is worse than not writing a check at all because
it costs the MT money and can cost a person's reputation as well, if the
bad check is used to pay other bills. I think if a person is in a
position to hire other MT's then no matter what else goes on the subs
should be paid first, before any personal use of any money, and it's the
MTSO's job to make sure the sub money is there.
My husband contracts subs in his business and at the end of the week
they are paid. This often means we front several thousand dollars while
we wait for payments. At times we've taken a hit when someone paid less
than agreed to, and we have to take that and learn from it, but it's our
position that the subs are never subjected to the whims of the money
circle, I think that's the contractor's role. After all, on every bit of
money the MT makes, the MTSO gets a cut. They at least deserve the
respect of being paid if they're holding up their end of the bargain
(correctly producing the work in a timely manner). I think it's the
second job of the MTSO (paying the sub) after the first job, which is
obtaining the work in the first place.

I'd be interested, Mary Rose, to know about issue of contacting the
facility. There are laws that allow liens to be placed, but not sure how
those would work in similar situations. Down to brass tacks: No matter
what the excuse, the money is owed. Writing checks that are bad is
illegal, I'm sure. Excuses made about client not paying, etc. - Hold no
water. The MT didn't contract with the MTSO's client, they contracted
with the MTSO. However, the excuses may be just that - excuses and
perhaps the facility would be interested in knowing they are paying
someone who is not paying their subs. It's bad enough - but it sounds
like this woman knew in advance she wouldn't be able to pay, and allowed
your daughter to work anyway - seems like a crime to me.
