Malpractice Realities

A July 20 article, "Cheney Urges Cap on Malpractice Awards,"
incorrectly says that lawsuits are on the rise and suggests that this
is the root of the health care problem in our country.

In fact, lawsuits from medical malpractice cases are not on the rise,
and capping claims will have no impact on malpractice insurance
premiums. In most states where caps have been enacted, insurance rates
have increased more rapidly than in states where there are no caps.

Capping claims is not the way to fix the problem. What is needed is
insurance reform. Unlike other areas, the insurance industry is exempt
from antitrust laws. Insurers are free to agree on prices, to raise
prices in concert and to engage in other anti-competitive activities
that are against the law in other industries.

The fact remains that a jury system without caps promotes quality
care, increases patient safety and reduces medical mistakes. Don't we
all want to live in a society where we encourage our doctors to
practice good medicine?
