"Overview of the Einsteinhoax Website"

I know there have been many attempts over the
years to stop this pseudo-faq spamming, and
the administrators

This is an unmoderated newsgroup, as are all that Ernest Wittke
posts to. There are no "administrators".

have declined to classify it as spam, but has
there ever been any discussion of the constantly
changing name of the originator?

Constantly. Discussion does not imply power. Wittke cares
neither for truth nor for rules. He posts for personal gain.

This seems to be purely intended to defeat
kill-files,

Correct.

meaning that the originator is intentionally
striving to impose the material on people who
are

"may be" or "want to", rather than "are"

specifically trying to avoid receiving it. If that
doesn't qualify as spamming, I don't know what
does.

Wittke holds to his own "morality".

So, wouldn't it be possible to appeal to the ISP
of the originator and have him banned?

Been done before. Will eventually have to be done again.

Just a follow-up: The defense spam that is
frequently posted here acknowledges that
the rules require that "There shall be no
alteration of the header material of the
postings."

.... and Jeff Relf pays no attention to those rules either.

And then the spammer goes on to say:

While the postings are made under many
different E-mail names, however my ISP
provides for multiple user names and permits
them to be altered at will.

This doesn't seem like a valid defense. The
question is not whether the ISP

.... actually "NSP" would be better / more correct, but Ernest
doesn't know better.

allows people to alter their email names at
will, the question is whether it allows someone
to do this specifically for the purpose of
spamming newsgroups.

Prove intent in the "newsgroup courts". You can't and there
aren't any.

The law for name changes in real life is written
in just this way, i.e., a person can change
their name at will, PROVIDED they are not
doing it for nefarious purposes.

Promulgating anti-semitism is a crime in some countries. But
usenet is not a country...

Clearly this spammer is doing these name
changes for no other reason than to impose
unwanted material on other people.

Actually, if you were to study his posting history, he developed
a persecution complex early on, before he knew that his own
messages were being marked "read", they would disappear from his
newsreader, so he is doing the nymshifting to keep his posts from
"kept from the world".

I really think a strong case can be made to
this individual's ISP provider that he should
be banned, or at the very least, he should not
be able to continue altering the name on his
spam postings.

Go for it. I tried, he got dumped, he started dumping *actual*
spam to usenet with my name on it, and he started up elsewhere.
He makes a living from spreading this ***.

How successful do you think you will be?
