Of course. That's not the issue. The issue is that if my salary is paid by tax dollars, I have an obligation to make my results public. Should I be compelled to? That's different- and I am concerned about NIH contemplating the release of everyone's raw data directly onto the Internet. Imagine the havoc that is going to cause w.r.t. drug trials.
If my salary is paid by a private company, using private funds, there is no obligation to release data- patent law is an attempt to address this, but it is seen in optics and computer science (the most obvious examples to me) that the process is inherently flawed.
